Greg’s Problem:
Greg was a fisherman who had been unable to afford his boat payments, as well as frequent boat repairs. His boat was repossessed, and he needed it back for his job.
TBC’s Solution:
Greg contacted TBC to discuss his options. His attorney filed a Chapter 13 for him, and shortly thereafter the creditor worked out a deal with TBC so that Greg could get his boat back.
Abby’s Problem:
Abby fell behind on her car payments, and her car was repossessed.
TBC’s Solution:
Abby came to TBC for her initial consultation a week after her vehicle was repossessed. After hearing her options, she decided to file a Chapter 13 Bankruptcy to catch up on her payments and get her vehicle back. TBC was able to file Abby’s bankruptcy before her vehicle was sold, and get the car back from the creditor for her.
Caroline’s Problem:
Caroline was struggling with medical, credit card, tax and utility bills, and had gotten behind on her mortgage payments. She started working on a loan modification with the mortgage company to prevent losing her house in foreclosure. The mortgage company told her that during the loan modification process she would be safe from a foreclosure. After a year of working with her bank on the loan modification, the mortgage company contacted Caroline to tell her she did not qualify for the loan modification, and that they were going to sell her home in less than a week.
TBC’s Solution:
Caroline came to TBC and filed a Chapter 13 Bankruptcy. The Chapter 13 immediately stopped the foreclosure and allowed Caroline to catch up on her mortgage payments over 5 years. In addition, the remainder of her bills were either paid or discharged through the bankruptcy.
Todd’s Problem:
Todd was in school, working on a certificate that would qualify him for a raise in pay. In the meantime, he had a loss in income which caused him to fall 16 months behind on his mortgage. When he obtained his certificate and got his raise, he attempted to catch up on his mortgage; however, the bank would not accept his payments and began to foreclose.
TBC’s Solution:
An attorney at TBC proposed an affordable Chapter 13 payment plan for Todd that allowed him to save his house.
Bobby’s Problem:
Bobby, an only child, was just ten years old when both of his parents were killed in a car accident. Bobby was the only heir of the estate, which included the family home. The life insurance proceeds did not arrive quickly enough to stop the mortgage company from filing a foreclosure on the house, naming both of the deceased parents, Bobby, and the estate in the suit. The attorney for the estate came to TBC looking for a way to stop the foreclosure for Bobby until the life insurance proceeds arrived.
TBC’s Solution:
TBC first researched to see if there was an age limitation on filing bankruptcy under the US Bankruptcy laws. There was not. The TBC attorney and the estate attorney determined that Bobby could file a Chapter 13 bankruptcy to catch up and continue to pay on his mortgage, using his parents’ social security income to make the monthly Chapter 13 plan payments. However, this option was clearly going to be the last resort. The estate attorney threatened the mortgage company with both bad publicity and a Chapter 13 bankruptcy filed by TBC if they continued with the foreclosure, and the mortgage company relented. The estate was able to pay off the house with the insurance proceeds when they finally arrived, and Bobby did not have to file bankruptcy to keep his house.
